1. Acceptance of Terms
By accessing or using the SiteBuddy platform ("Platform"), you agree to be bound by these Terms of Service. The Platform is operated by Oculus (Aust) Pty Ltd (ABN 14 681 800 724) ("we", "us", or "our"). If you do not agree to these terms, please do not use the Platform.
2. Platform Description
SiteBuddy is a marketplace platform that connects customers seeking construction site services with qualified service providers. We facilitate connections and payments but are not a party to the service agreements between customers and providers.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use.
4. Provider Obligations
Providers must hold all required licences, insurances, and qualifications for the services they offer. Providers must maintain accurate compliance documentation and notify SiteBuddy of any changes to their compliance status. Providers agree to a 7.5% platform commission deducted from each completed booking.
5. Payment Terms
Payments are processed via Stripe. Customers pay a 5% deposit upon accepting a quote, with the balance due upon acceptance of deliverables. SiteBuddy deducts its platform fee before disbursing funds to providers. All amounts are in Australian dollars (AUD) and inclusive of GST where applicable.
6. Disputes
In the event of a dispute between a customer and provider, SiteBuddy will attempt to mediate but is not obligated to resolve disputes. SiteBuddy may hold funds in escrow during a dispute investigation. Decisions made by SiteBuddy during mediation are final and binding.
7. Intellectual Property
All content, trademarks, and intellectual property on the Platform are owned by or licensed to Oculus (Aust) Pty Ltd. You may not reproduce, distribute, or create derivative works without our prior written consent.
8. Limitation of Liability
To the maximum extent permitted by Australian law, SiteBuddy's liability for any claim is limited to the platform fees paid by you in the three months preceding the claim. We are not liable for the quality, safety, or legality of services provided by providers.
9. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Queensland.
